पीटीआई, नई दिल्ली। विदेशियों के आव्रजन, भारत में प्रवेश और ठहरने को विनियमित करने वाला 'आव्रजन और विदेशी विधेयक, 2025' बुधवार को राज्यसभा में भी पारित हो गया। यह विधेयक 27 मार्च, 2025 को लोकसभा में पारित किया गया था। विधेयक में विपक्षी सदस्यों द्वारा सुझाए गए कई संशोधनों को अस्वीकार किए जाने के बाद राज्यसभा ने इसे ध्वनिमत से पारित कर दिया।

विधेयक में एक प्रमुख प्रविधान यह है कि भारत में प्रवेश करने या देश में रहने या देश से बाहर जाने के लिए फर्जी पासपोर्ट या वीजा का उपयोग करते हुए पाए जाने वाले किसी भी व्यक्ति को सात साल तक की जेल की सजा और 10 लाख रुपये तक का जुर्माना हो सकता है।

विधेयक में भारत आने वाले प्रत्येक व्यक्ति पर कड़ी निगरानी रखने का भी प्रविधान है। प्रस्तावित कानून में होटल, विश्वविद्यालय, अन्य शैक्षणिक संस्थानों, अस्पतालों और नर्सिंग होम द्वारा विदेशियों के बारे में अनिवार्य रूप से सूचना देने का प्रविधान है, ताकि निर्धारित अवधि से अधिक समय तक रहने वाले विदेशियों पर नजर रखी जा सके।

बहरहाल, इस विधेयक पर चर्चा का जवाब देते हुए गृह राज्य मंत्री नित्यानंद राय ने पिछली कांग्रेस सरकार और पश्चिम बंगाल की तृणमूल सरकार पर अवैध प्रवासियों को देश में प्रवेश करने में ''मदद'' करने और मतदाता सूची तथा राशन कार्ड में उनके नाम शामिल करके उनके ठहरने को ''सुविधाजनक'' बनाने का आरोप लगाया।

हालांकि, इस पर कांग्रेस और तृणमूल के सदस्यों ने कड़ी आपत्ति जताई और अन्य विपक्षी दलों के सांसदों के साथ सदन से वाकआउट कर गए।चर्चा के दौरान राय ने कहा, ''26 सदस्यों ने विधेयक पर अपने विचार व्यक्त किए। हमारे विश्वविद्यालयों, शिक्षा प्रणाली और अर्थव्यवस्था को विश्वस्तरीय बनाने के लिए यह विधेयक लाना आवश्यक था।'' उन्होंने कहा कि देश में उन सभी लोगों का स्वागत है जो शिक्षा, शोध और विकास कार्यों के लिए यहां आते हैं। उन्होंने इस बात पर भी जोर दिया कि उन सभी विदेशी नागरिकों से निपटने की जरूरत है जो राष्ट्र विरोधी गतिविधियों में लिप्त हैं।

कांग्रेस सांसद अभिषेक मनु सिंघवी ने कहा कि इस विधेयक से यह संदेश जाता है कि सभी विदेशी ''संभावित अपराधी'' हैं, जिन्हें भारत द्वारा गंभीर संदेह की दृष्टि से देखना चाहिए। विधेयक का विरोध करते हुए उन्होंने मांग की कि इसे स्थायी समिति को भेजा जाना चाहिए क्योंकि यह निम्न अधिकारियों को अत्यधिक शक्ति प्रदान करता है और इसमें अपील, निगरानी और जवाबदेही के प्रविधानों का अभाव है।

उन्होंने कहा कि सरकार का दृष्टिकोण केवल उस मानसिकता को दर्शाता है जिसमें विदेशियों को सम्मान और गरिमा वाले व्यक्ति के रूप में नहीं, बल्कि ''अवमानना और घृणा की वस्तु'' के रूप में देखा जाता है। समानता, जीवन और स्वतंत्रता के अधिकार जैसे संवैधानिक प्रविधानों पर प्रकाश डालते हुए उन्होंने कहा कि संविधान नागरिकों के समान ही गैर-नागरिकों को भी कई अधिकारों की गारंटी देता है।
